防倒閉求償無門 推補習班履約保證
: 【台灣醒報記者楊蕓台北報導】近年時常傳出大型補習班突然倒閉，影響學生權益深遠。教育部公告「短期補習班補習服務契約書範本」，要求補習班需透過信託或加入品保協會等組織，提供學生「履約保證」，將於7月上路。中華民國補教業品保協會理事長20日在記者會上表示，協會將提供合格標章，業者可張貼在補習班門口，若會員因故倒閉，學生則可透過協會申請同性質、價位的課程服務，讓學習不中斷。
近年來，不少補習業者因招生不足、財務缺口而導致無法繼續經營的狀況時有所聞，尤其若發生在大型連鎖補習班，影響學生數量更是深遠。因此，為保障消費者權益，教育部公告修正「短期補習班補習服務契約書範本」，並自今年7月1日生效。
目前全國有1萬7659家短期補習班，大多屬於「預付型服務」。教育部終身司長黃月麗表示，定型化契約規定，「非按月收費」補習班必須提供履約保證機制，有3種方式可選擇，第一是補習班自行開立信託專戶，把收費總金額30％交付信託；第二是提供金融機構履約保證；第三則是加入補習服務聯合連帶保證。違者可依消費者保護法處3萬元以上30萬元以下罰鍰；經再次令其限期改正而屆期不改正者，處5萬元以上50萬元以下罰鍰，並得按次處罰。
中華民國補教業品保協會理事長邱昌其表示，由於多數金融機構的履約保證必須有資本額3000萬元的門檻限制，大多補習業者都是中小型補習班，造成很大的困擾，因此整合全國各類型、大小的補習班，成立「中華民國補教業品保協會」，「目前已有超過千家業者申請，且陸續增加中，目標2年內達到5千到1萬家。」
邱昌其進一步說明，中華民國補教業品保協會提供聯合連帶保證協定，完整保障消費者權益，會員有識別標誌，可張貼於補習班門口，方便消費者辨識。若某補習班不幸倒閉，補習班學員可在6個月內，向品保協會尋求在性質相近的補習班換取等值服務，除了採一班面授課方式外，也可利用函授、廣播、電視、網路等多元方式辦理。
履約保證機制將自7月1日起生效，邱昌其也提醒，消費者選擇補習班時，除認明貼有標章的補習班，或直接到品保協會網站上搜尋合格業者，也提醒消費者保留每學期的學費收據，萬一發生倒閉事件時可快速申請補償服務，「如果補習班採『一次收費』，卻開立『多張收據』，顯然是刻意規避教育部所訂定的定型化契約規定，消費者需特別留意。」
